1. Acceptance of Terms

By accessing or using the BeniSave website located at www.benisave.com (the "Site"), purchasing a BeniSave Options Report, or using any of the services described on the Site (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Site or Services.

These Terms apply to all visitors and users of the Site, regardless of whether you purchase a report.

2. What BeniSave Is

BeniSave is an educational decision-support tool. BeniSave helps consumers identify, compare, and understand non-insurance healthcare options based on information the consumer provides through an assessment.

What BeniSave Is Not

• BeniSave is not health insurance

• BeniSave is not a licensed insurance broker or agent

• BeniSave does not sell, enroll consumers in, or administer healthcare plans or programs

• BeniSave does not provide medical, legal, tax, financial, or insurance advice

• BeniSave is not a healthcare provider, health plan, or healthcare clearinghouse

• BeniSave is not a substitute for professional medical advice, diagnosis, or treatment

3. No Recommendations

BeniSave presents options for you to review and evaluate. BeniSave does not recommend, endorse, or suggest that you choose any specific healthcare provider, plan, program, or service. The options presented in your report are based on the information you provide and are intended to help you understand what may be available — not to tell you what to choose.

Any decision to enroll in, purchase, or use any healthcare option is yours alone. You should independently verify all information, including pricing, eligibility, provider availability, and program terms, directly with the provider before enrolling or paying.

4. Important Limitations

These Options Are Not Insurance

The healthcare options presented in your BeniSave report are non-insurance alternatives. They do not meet the Affordable Care Act's requirement for minimum essential coverage unless specifically stated otherwise for a particular option.

Major Medical Events Are Not Covered

Most options presented in your report do not cover hospital care, surgery, emergency treatment, or major medical events. You remain fully responsible for the cost of any medical care you receive that is not covered by a program you choose to enroll in. BeniSave strongly encourages you to understand the limitations of any option before relying on it.

Health-Sharing Ministries

If your report includes health-sharing ministry options, you should understand that:

• Health-sharing ministries are not health insurance

• They are not legally obligated to pay claims

• They do not meet ACA minimum essential coverage requirements

• Membership may require faith-based or religious eligibility

• Pre-existing conditions may be excluded or subject to waiting periods

• Annual or lifetime sharing limits may apply

BeniSave does not receive any commission or referral fee from any health-sharing program.

State Mandate Notice

5. Your BeniSave Options Report

When you purchase a BeniSave Options Report for $69, you receive a personalized report based on the information you provide in the assessment. The report is generated using BeniSave's matching methodology, which considers your state, household, budget, healthcare needs, and preferences.

What the Report Includes

Your report may include healthcare options organized by category, estimated cost information, eligibility considerations, and questions to ask before enrolling. The specific content of your report depends on the information you provide.

What the Report Does Not Include

• A recommendation or endorsement of any specific option

• A guarantee that any option will accept you as a member or patient

• A guarantee of pricing, savings, or outcomes

• Medical, legal, tax, or financial advice

• An assurance that any option is appropriate for your specific health situation

No Warranties

Your BeniSave Options Report is provided "as is" and "as available," without warranties of any kind, express or implied. BeniSave does not warrant that the report will be error-free, complete, or suitable for your particular purpose.

6. Assessment Accuracy

The quality and usefulness of your BeniSave Options Report depends on the accuracy of the information you provide in the assessment. You are responsible for providing accurate and complete information. BeniSave is not responsible for reports that are incomplete or inaccurate due to incorrect, incomplete, or misleading information provided by you.

7. Payment

The BeniSave Options Report is offered for a one-time fee of $69. Payment is processed by a third-party payment processor. BeniSave does not store your full credit card or payment account number.

8. Intellectual Property

The BeniSave website, report format, matching methodology, option database, and all related content are the property of BeniSave and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site or your report without our written permission.

You may print or save a copy of your personalized report for your own personal use. You may not share, sell, or distribute your report to others.

9. Third-Party Links and Providers

The Site and your report may contain links to third-party websites and references to third-party healthcare providers, telehealth platforms, and other services. BeniSave does not control and is not responsible for the practices, content, quality, or availability of any third-party website or provider.

Your interactions with third-party providers are solely between you and that provider. BeniSave is not a party to any transaction you enter into with a third party.

• Impersonate another person or misrepresent your identity

12. Disclaimer of Liability

BeniSave provides educational and informational services only. BeniSave is not liable for:

• Any healthcare decisions you make based on your report

• Any outcomes resulting from your use of, or failure to use, any healthcare option

• The actions, practices, or quality of any third-party provider

• Any medical condition, injury, or harm you experience

• Any financial loss resulting from your enrollment in or use of any healthcare option

• Any inaccuracies in pricing, eligibility, or availability information

To the maximum extent permitted by applicable law, BeniSave, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or Services, even if BeniSave has been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless BeniSave, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Site or Services, your violation of these Terms, or your breach of any law or third-party rights.

14. Limitation of Liability

Your sole and exclusive remedy for any dispute with BeniSave is to discontinue using the Site and Services. In no event shall BeniSave's total liability to you exceed the amount you paid for your BeniSave Options Report ($69).

15. Children

The Site and Services are not directed to individuals under the age of 18, and BeniSave does not knowingly collect personal information from children under 18. If you are under 18, do not use the Site or purchase a report.

16. Changes to These Terms

BeniSave may update these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice on the Site. Your continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws provisions. Any dispute arising from these Terms or your use of the Site or Services shall be resolved in the courts of North Carolina, unless a different venue is required by applicable law.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
